It is the jockeying for prestigious appointments, the appointments of “close personal friends” to positions of proximity and power. There are several pictures that come to mind. CORPUS CHRISTI - District Attorney Carlos Valdez has filed a motion asking that Judge Manuel Banales be removed from the Mauricio Celis case.

Mauricio Celis was convicted in February 14 counts of falsely claiming to be a lawyer.

The judge in that case, Mark Luitjen, decided on a one-year jail sentence and a $1.35 million fine.

However, Judge Luitjen was removed from the case before the sentence became official. The judge was removed on a defense motion.

Judge Banales took over the case and sentenced Celis to 10 years probation with no jail time. Banales also assigned Judge Richard Terrell out of Alice to handle the cases still pending against Celis. Banales left himself as the judge of record in the first Celis case.

A total of five judges have now handled the Celis case.

The motion filed by the District Attorney raises concerns over what Valdez said are conflicts of interest between Celis and Judge Banales.

In a picture on from the Caller Times, standing side-by-side are Judge Banales, his wife Peggy, Tony Canales and his wife Yolanda at a reception.

Canales represented Celis in his first trial.

According to court documents filed by Carlos Valdez, Judge Banales has had long-standing financial and other relationships, not only with Celis' trial counsel, but also various lawyers and law firms whose conduct is directly at issue in the criminal cases.

According to court documents signed by Valdez, the attorneys and law firms would benefit if Judge Banales were to consider granting new trials in cases in which Celis has been convicted.

In May, Judge Banales granted a request from Celis to remove Judge Luitjen from his first trial, and bring himself to the trial.

According to court documents, Judge Banales stated, I will assign myself the case for "the purpose of the rendition of judgement." Whether I continue after that, "I will determine later on."

According to court documents, in 1993, Judge Banales unsuccessfully sought the appointment to a federal district judge position in Corpus Christi.

Recommendations for appointments are made through a judicial selection committee and Celis' Attorney Tony Canales has been appointed to the committee.

The documents state that a federal judge vacancy will occur in the Corpus Christi Division in the near future.

Judge Banales has two options: to recuse himself from participating in the disputed cases or to refer the District Attorney's complaint to the Chief Justice of the Texas Supreme Court to make a decision.

Court staff said Judge Banales hasn't had a chance to read the motion to recuse himself from the Celis case.

The City of Corpus Christi Impound Lot fees (accruing by the minute) are the mechanism that places so many vehicles on the auction block, any one familiar with the Impound Policies can easily notice a vehicle sinking in quicksand. It is wrong to blame an insider for taking the opportunity when the city policies are the reason people lose their vehicles. In a nutshell the fee to get the vehicle was already out of reach for the owner to pay, the problem is somebody else had their eyes already focused on the vehicle and didnt get it. In other words the owner had already lost the vehicle and the officer at least gave them more than they would have ever received from the city. The same methodology applies with the property tax seizures, an one familiar with the Nueces County Policies can interdict a property before it becomes the property of the County. The outrageous and unconscionable price gouging will make even the fortunate ones who pay the ransom say OUCH!

Letter From Carjacking Victim's Father

I sent the following message to all of the city council members, the mayor and the city manager.

My son was carjacked and attacked with tire irons last Sunday night November 23, 2007 at 5pm in the parking lot of Wings and More on Staples and Wooldridge. He was pulled form his car while parked with the engine running. One of his attackers threatened that he was going to kill my son when my son fought back and defended himself. He received several injuries including a tire iron to the face which required stitches and left my son with a cheek broken in three places. He was also hit in the back of the head with a tire iron by a second attacker and had his finger broken while defending himself from the tire iron attack. A female Tammy Bond had arranged for my son to meet her at this location. My son ran to Wings and More to get away from his attackers when he heard a the third Hispanic male threatening to kill him while reaching into a vehicle for what my son thought might be another weapon, possibly a gun. The woman Tammy Bond proceeded to drive off in my sons car.

The car was found the next morning completely cleaned out. The carjackers got my sons laptop, calculator, text books, schoolwork projects and notes. they also stole his work clothes and bartending supplies. My son has suffered physical and emotional damage. He is a Deans list student at TAMU and has had to take an incomplete in one class and may lose one of his part time jobs because he has to makeup time for losing his school materials before finals The car itself has sustained several thousand dollars in damage.

To add insult to injury the Corpus Christi Police Department Impound lot charged my son $193.30 for towing and impounding his car for one day. A city police office has informed me that the city only pays $25 for towing. There was only one "clerk" to handle the crowd of people trying to get their vehicles released. Fortunately we did have the resources to get my sons car out of the impound lot before the interest accrued to the point where the city would have been the second carjacker in less than a week. Fortunately he was able to get his car started without my help because only one of us was allowed to inspect the car and remove it from the impound lot. Another unnecessary obstacle to retrieving the vehicle. It is incredible to me the hurdles the city has placed to prevent people form getting their cars out of impound. No wonder several police officers were able to scam the public at the impound lot. Unfortunately it is the very policy of the city that appears to have made their scam work. I believe I am entitled to and want an accounting from you and the City of Corpus Christi to explain to me how a $25 towing fee can be inflated to $193.30 and why the City of Corpus Christi has further victimized my son.

We picked up my sons car last week. Attached is the receipt showing the charges we had to pay to get his car released. I erased his name and address on this receipt. We will have to have the auto cleaned as it was covered inside and outside with fingerprint dust (I'm not complaining about the cleaning.) Just one more expense. Brought the car into the shop where they found brake damage all around. Tie rod damage. A cracked radiator and windshield. All of which my mechanic assures me was most probably caused by the carjackers. My mechanics records do not show any of these problems and he has been maintaining the car since we purchased it from its original owner two or three years ago. The insurance company, State Farm is only willing to pay for the brake and windshield damage. We have also requested that the insurance company kicks in for changing the locks as the thieves still have his car keys. The insurance company is refusing to pay to re-key the car. Not like these carjackers live in New York or Detroit. My son met this woman where he was working as a bartender. What's to stop her or her friends from finding his car where they know he works and stealing it again with the keys? We are still negotiating. Anyhow, all his school books, papers, calculator and lap top are gone and not covered by our home insurance or car insurance. His work clothes, shoes, and bartending supplies were also stolen. Even the car manual was stolen. His car was completely emptied. the only thing they left was the doughnut spare. My son has had to take an incomplete in one course and may lose a part time day job because he had to ask for the time off to catch up on studying for his finals without his notes, calculator, memory sticks and laptop. Then there is the inconvenience to the family as we are now down one car and have to share our vehicles so everyone can get where they need to go. I'll have to re-key all the house locks because they got his house keys. I won't recount here the physical and emotional injuries my son is suffering from or the emotional toll it has taken on myself and his mother and sisters. We are all looking over our shoulders and double locking the doors. Anyhow, with all this c*#! it really burns me to have to pay the city $193 for towing and storing his car. One police officer I have heard from has informed me that towing costs the city $25. If the city impound lot belongs to the citizens, why I am paying them rent for the property that belongs to me. Truth is I have resources so all though it hurts I can pay to get my car released.

The night of the crime the police went to this womans house, her name is Tammy Bond. There were three males with her. One had outstanding warrants so they arrested him. My son picked out two of the three from a photo lineup as his attackers. The last we heard there are warrants out for the carjackers my son identified.

field investigation conducted predominantly by a single agent who has
signifigant ties to the drug dealer Aldrete. Aldrete was in our country,

name to me is an obvious red flag. Also these two border patrol agents are

from the other farmyard animals to plant it. No one is willing to help. W

Just wanted to share this with everyone. The resolution we passed regarding
the two Border Patrol Officers made Lou Dobbs and now it appears CNN wants
to speak with us. Pretty cool. Kudos go out toe Elvia and Xavier on this.

Per the call from CNN yesterday, information below from CNN Lou Dobbs Show
mentioning LULAC Texas resolution. Reporter still wanting information as to
why LULAC Texas has decided to take this position.

"Still ahead here, charges tonight that prosecutors withheld key evidence in
the trial of two former Border Patrol agents sent to prison.

We'll have that special report.

And Homeland Security Secretary Michael Chertoff, well, he's praising
efforts to build a fence along our southern border with Mexico. Our border,
however, is wide open to illegal aliens, to terrorists, to drug smugglers.

We'll have that story.

And the war on our middle class, it's escalating. New government figures
tonight illustrate the worsening plight of working men and women in this

DOBBS: Important new developments tonight in the case of imprisoned former
Border Patrol agents Compean and Ramos. Both sentenced to lengthy prison
terms for shooting and wounding an illegal alien drug smuggler whom the
prosecutors then gave immunity to testify against the agents. One of the
defense attorneys now says government prosecutors failed to disclose a key
document during that trial. A document that could have undermined the
government's entire case.

Casey Wian has the story.

(BEGIN VIDEOTAPE)

CASEY WIAN, CNN CORRESPONDENT (voice over): At the heart of the
prosecution's case against former Border Patrol agents Ignacio Ramos and
Jose Compean was the alleged cover-up of the shooting of a Mexican illegal
alien drug smuggler. Now the online publication WorldNetDaily reports the
existence of a Homeland Security Department document suggesting two Border
Patrol supervisors were at scene and knew about the shooting.

That's consistent with the agents' statements that they did not report the
shooting because they believed supervisors already knew about it. The
attorney for Ignacio Ramos says prosecutors never disclosed the existence of
the documents, which could be grounds for a new trial.

MARY STILLINGER, ATTORNEY FOR IGNACIO RAMOS: The government is really
charged with a higher responsibility than just winning a case. The
government is charged with seeking justice in trying to do the right thing.

So they can't hold back on evidence just because it's helpful to the
defense. And, if fact, they have an obligation to turn that over.

WIAN: The document lists the names of Border Patrol agents and supervisors
who were at the scene. It also says, "Investigation disclosed that none of
the above agents reported the shooting or the subsequent cover-up."

REP. TED POE (R), TEXAS: The more that comes out about this case, the more
it seems that the prosecution was relentless in making sure these border
agents were convicted. And this is just another example of another piece of
evidence that the defense should have known about, the jury should have
known about during the trial to make their determination on whether these
border agents even violated the law or not.

WIAN: U.S. attorney Johnny Sutton did not return calls seeking comment on
the new evidence and other documents raising questions about his decision to
prosecute the agents and grant immunity to an admitted drug smuggler.

UNIDENTIFIED MALE: I think our police officers, our law enforcement have
been undermined. WIAN: Meanwhile, Ramos and Compean supporters are raising
money to buy air time for these television ads demanding the White House
pardon the former agents.

WIAN: Finally, the Texas branch of the Latino advocacy group LULAC has
drafted a resolution supporting a pardon for Ramos and Compean. LULAC says
it believes the 11 and 12-year sentences were too harsh -- Lou.

*DOBBS: Well, it's what now, four months since the sentencing? LULAC taking
this stand. I have to give them credit. *

They have been absolutely absent in this case despite the fact that both of
these agents are Hispanic-Americans. Did they have any indication as to why
they were joining in this now?

*WIAN: No, they did not. We asked them for further clarification, more
information about -- about this position they've taken. They didn't give it
to us. We're still hoping we'll get it soon.

What we did find out, though, there's a couple of other leading Latino
advocacy groups. MALDEF and the National Council of La Raza still are
refusing to take up position on this issue -- Lou.

Last week LULAC & the American GI Forum held a Press Conference regarding
the recent Border Patrol injustice.

Many of the DHS investigative reports were filed by Christopher Sanchez, who
appears to have played a major role in the DHS field investigation. Sanchez
appears to be playing a role shepherding the drug dealer around and framing
the evidence that ended up being used by Johnny Sutton to put Ramos and
Compean in prison for 11 and 12 years respectively." This cover up has
raised Red Flags and revealed Conflicts of Interest involving DHS Agent
Chris Sanchez and the wrongful Imprisonment of BP Agents Ramos & Compean.

Now, the local media after attending the press conference and conducting in
depth interviews with the LULAC and AGIF officials refuse to broadcast
anything involving this issue.

We believe there is an attempt to quash this story and the effort to bring
forth justice for these two men.

We are willing to appear on your show or do what is necessary to achieve
Justice for these men. We ask for your assistance in bypassing the local
media entities so we might bring justice for the agents.

One of the Media Present was Jaime Powell who was the only media contact
when the Cheney Whittington incident was released. We feel there is a govt
censorship in place on this issue. Once again we request your assistance.

I was a candidate for the Del Mar Board of Regents. I picked up the package to run for office. I am College Educated. I have several degrees. I'm pretty good at reading and writing contracts and such. I'm not a lawyer and believe me I could have used a lawyer to explain all the stuff I was responsible for and had to do. Del Mar wasn't going to explain it to me and the local party bosses wouldn’t have anything to do with me. Del Mar certainly wasn't going to help Linda whose brother they had railroaded out of a job. Now Linda was the first person in a Corpus Christi Public Housing development to successfully run for a public office and her neighbors were very proud of her. So here we have a person who picked herself up by her bootstraps with out the aid of the local democratic or republican bosses and won her election. So what do the local politicos do and that includes our slimy DA, they go after her and shoot her down. Got to keep those lower classes out of local politics or who knows what might happen. Just for those of you who do not know, she wasn't welcomed by the Board either. I have no doubt from my many years of experience with Del Mar College if Linda had been a Regent the College wanted, the DA would never have brought charges; as much as people like me would have screamed for it. Adler and her cronies were looking for any excuse to get Linda out that they could dig up. Now Gabe Rivas, who was voted out of office by the community he was supposed to have served; because he mostly served himself and the corrupt DMC administration, wants his job back. We are looking at a long term appointment here. I hope this community puts the College on notice that another election is called for here.
